There may be important changes to the law happening next week.
At present Scottish criminal suspects can be interviewwed and detained by the police under Section 14 without a lawyer present or without being given legal advice. This does not happen in other parts of Eurpoe and may be illegal.
This all may CHANGE on or after Tuesday 26th October 2010 - when the judgement by the Supreme Court in the case of Peter Cadder is expected to be published. In the Cadder case, an appeal from the High Court was argued earlier this year after Mr. Cadder was convicted of an Assault abd Breach of the Peace after a Trial where the Crown had led evidence which he provided while being interviewed by police without a lawyer being present.
The outcome of Cadder may bring us into line with other European legal systems and could mean you have an appeal. We at Nicholas J.
